Web Hosting
Hosting Payments
All hosting payments, whether for present or past months, are non-refundable. Web hosting accounts are set up from the date of your order and are allotted a limited amount of server resources depending on the plan purchased. If a client opens a hosting account but does not use it, payment will still be due. Hosting billing cycles continue until a cancellation notice is received from the client in writing.
Automatic Billing
Unless otherwise provided, you agree that until and unless you notify Eight Hats of your desire to cancel the web hosting services, you will be billed on an automatically recurring basis. Payments will be charged using your credit card or other billing information on file with us. Additional fees may apply for credit card usage.
Chargebacks
We will ask the client for payment info so that we can charge the client for services provided, or we will send an invoice so that you can pay with a payment option of your choosing. If you have not opted into autopay, you must submit payment at the time of your receipt of the invoice. Any accounts taking 30 days for payment will incur late fees and are subject to suspension of the website and cancellation of services. If we receive a chargeback or payment dispute (i.e., PayPal Dispute) from a credit card company or bank, your service and/or project will be suspended without notice. A $50 chargeback fee, plus any outstanding balances accrued as a result of the chargeback(s), must be paid in full before service is restored, files delivered, or any further work is done. Instead of issuing a chargeback, please contact us to address any billing issues. Requesting a chargeback or opening a PayPal dispute for a valid charge from us is fraud, and is never an appropriate or legal means of obtaining a refund. Please read and make sure you fully understand our refund policy prior to making a payment.
Website Content Updates
When requesting new text and/or content to a page, the client is responsible for providing all text (in digital format) and images/photos. Unused hours do not roll over to subsequent months. No refunds are provided for unused hours. There are absolutely no refunds for any fees related to website maintenance services. Our support plans are dependent on the scope and size of a website and are quoted on an annual or monthly basis. Especially for websites that we did not initially build, website maintenance and upkeep require extensive upfront resources and time to learn the setup, framework, and specifics of a new client’s website, thus we require annual or monthly maintenance to be paid in full unless determined otherwise.
Web Development
Web development projects require extensive resources, consume our time, and incur internal expenses. Therefore, once a payment or deposit is made, it is non-refundable. Payments for development projects (full website development, individual page mockups, and smaller development components within a website, etc.) and custom development projects (i.e., PHP programming, WordPress CMS custom development, WordPress Plugin custom development, etc.) are made to us in increments as a courtesy to the client, but if a project is canceled, delayed, or postponed by the client, then all monies paid will be retained by Eight Hats. If applicable, an additional cost will be charged to the client for all work completed beyond what was already paid for. All projects that are completed as defined by the scope of the work are non-refundable.
Research and Development
Clients need to be responsible for providing us with a designed layout or child theme/template. Eight Hats can provide our library of templates and other resources. However, agencies or clients will be responsible for providing or choosing the site’s design unless they agree to pay for Research and Development. This would also set up a new phase in the project that takes a specified number of weeks to complete, based on the size of the project or the number of unique page designs. Eight Hats can then take the time to find an appropriate template based on provided site examples by the client or agency.
Domain Name Purchases
All sales of domain names are final once a domain name has been purchased. Domain name sales require a payment in full before transferring the purchased domain name. If Eight Hats purchases a domain name on your behalf, any and all fees associated with your domain name will be billed to you.
Website Suspension Policy for Non-Payment
Suspension Procedure
Effective immediately, any website hosted and managed by Eight Hats will be subject to suspension after 30 days of non-payment. A reactivation fee will be required to restore services. If payment has not been received by the due date, the website will be suspended. Suspension includes disabling the website and any associated services provided by our company.
Reactivation Procedure
Upon suspension, customers will be notified via email, explaining that their website has been suspended due to non-payment and that a reactivation fee is required. To reactivate the suspended website, the customer must pay the total outstanding invoices plus a reactivation fee of $150. Payment instructions will be provided in the suspension notification email. Once payment is received, reactivation of the website and associated services will occur within 24 hours.
Avoid Disruption with Autopay
To avoid the disruption of your website due to non-payment, we strongly recommend signing up for autopay. Autopay ensures that your payments are automatically processed, preventing any interruption in service. Enroll in autopay on your most recent invoice (example here).

By hosting your website with our company, you agree to adhere to this Website Suspension Policy for Non-Payment.
Amendments
This policy may be amended from time to time at the discretion of our company. Customers will be notified of any changes in advance.
Canceling Services
Eight Hats is not responsible for transferring websites from the Eight Hats web servers and reserves the right to charge for any web hosting transfer requests. Upon termination of services, Eight Hats will provide all files and relevant accounts for the operation of the website. Any plugins and licenses provided by Eight Hats will be removed from the website. If you wish to cancel your services, you must notify us by filling out the following cancellation form.
How Refunds Are Processed
If you have paid using your credit card, the money will be transferred back to your credit card account within 30 business days after approval. If you paid using a check or money order, your refund will be returned to you by check.
E-commerce Hosting and Support
- General Overview
By using the services provided by Eight Hats, you agree to comply with and be bound by the following terms and conditions. Please review them carefully, as they form a binding agreement between you and Eight Hats.
- Service Scope
Eight Hats provides managed website hosting services, primarily to marketing agencies and businesses. Our services include, but are not limited to, website hosting, website maintenance, security features, backups, and other related services.
- Uptime Guarantee and Limitations
Eight Hats strives to provide high uptime and reliable hosting services. However, while we take all reasonable measures to ensure uninterrupted service, we cannot guarantee that your website will be available at all times. Scheduled maintenance, technical updates, and unforeseen circumstances such as internet disruptions or server failures may result in temporary downtime.
- Limitation of Liability
Eight Hats provides hosting services “as-is” and “as available.” By agreeing to these terms, you acknowledge and agree that:
- Eight Hats is not responsible for any direct, indirect, incidental, special, or consequential damages that result from the use of, or inability to use, our services, including, but not limited to, loss of profits, business interruption, or data loss.
- In the case of e-commerce websites hosted with Eight Hats, the company is not liable for any loss of sales, revenue, or business opportunities arising from, but not limited to:
- Website downtime or unavailability
- Errors in website functionality
- Delays in website updates or security patches
- Issues caused by third-party integrations, plugins, or external services
- Cyberattacks, hacking incidents, or other security breaches
While we implement robust security measures and backups to safeguard your website, Eight Hats does not guarantee the prevention of all data breaches or cyberattacks. You are solely responsible for implementing additional security features if your website requires enhanced protection beyond the standard services offered.
- Customer Responsibilities
As a customer, you agree to:
- Provide accurate and up-to-date information for your account.
- Maintain your own website’s e-commerce transactions and related operations. (ex: shipping, extra fees, etc.)
- Ensure that your website is regularly updated and tested for functionality after changes are made.
- Regularly monitor your website’s performance and sales, and notify Eight Hats promptly if you experience any issues or downtime.
- Third-Party Services and Plugins
Eight Hats may provide recommendations for third-party services or allow the use of third-party plugins and software in conjunction with our hosting services. However, Eight Hats is not responsible for any issues, damages, or interruptions caused by third-party products or services.
- Service Termination
Eight Hats reserves the right to suspend or terminate your hosting services without notice if you violate these terms or engage in activities that harm or jeopardize our servers, network, or other customers.
- Indemnification
You agree to indemnify and hold harmless Eight Hats, its employees, affiliates, and partners from and against any claims, liabilities, damages, losses, and expenses, including attorney’s fees, arising out of or in any way connected with your use of the services, including any third-party claims.
- Modifications to the Terms
Eight Hats reserves the right to modify or update these terms at any time, with or without notice. It is your responsibility to regularly review these terms to stay informed of any changes.
